Welcome to Diona The Trainer! These Terms and Conditions ("Terms") govern your access to and use of the services, website, and online programs provided by Diona The Trainer ("we," "us," or "our"). By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1. Acceptance of Terms

By visiting our website (www.dionathetrainer.com) and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Services Offered

Diona The Trainer provides the following services:

  • Personalised Private Dog Training Sessions (Face-to-Face & Online): One-on-one training sessions for adult dogs, conducted either in-person in Melbourne, Australia, or online for overseas clients.

  • Online Puppy Program (Individual Sign-ups): A 9-week self-paced online program for puppy owners, supported via WhatsApp messaging.

  • Online Puppy Program (Breeder Partnership): A discounted version of the online puppy program offered to breeders for their puppy families, including a breeder toolkit and optional live sessions.

  • Free Resources: Downloadable guides and other content provided to users for free, typically in exchange for contact information.

3. User Obligations

By using our services, you agree to:

  • Provide Accurate Information: All information you provide for bookings, payments, or program access must be accurate, current, and complete.

  • Responsible Pet Ownership: You acknowledge that dog training involves working with live animals, and you are solely responsible for the safety, well-being, and actions of your dog(s) during and after training sessions or program participation. You must disclose any known aggression or behavioural issues prior to booking.

  • Follow Instructions: You agree to follow all instructions and safety guidelines provided by Diona The Trainer during sessions and within program content.

  • Appropriate Use: You will use our services and content only for their intended purpose and in a manner that does not violate any applicable laws or regulations.

4. Payment & Refunds

4.1 Payment Terms

  • Private Sessions: Full payment is required at the time of booking to confirm your session.

  • Online Puppy Program (Individual): Full payment is required at the time of sign-up to gain access to the program.

  • Online Puppy Program (Breeder Partnership): Full payment for the entire litter is required upon commitment to the partnership. An invoice will be issued upon your commitment submission and must be paid in full to activate access for your puppy families.

4.2 Refunds & Cancellations

  • Private Sessions:

    • Sessions cancelled within 48 hours of session time will incur a $100 fee.

    • Sessions cancelled more than 3 calendar days before will be rescheduled at a mutually agreeable time, within 2 weeks of original book date.

    • Rescheduled sessions not held within 2 weeks of original book date will forfeit the full session fee.

  • Online Puppy Program (Individual): Due to the digital nature of the content and immediate access to materials, refunds are generally not provided once access has been granted. Exceptions may be considered on a case-by-case basis at our sole discretion if requested within 7 days of purchase and no significant portion of the course has been accessed.

  • Online Puppy Program (Breeder Partnership): Once payment is received and access is granted to puppy families (at 5 weeks of age), no refunds will be provided for the litter. This includes situations where individual puppy families do not engage with the program.

5. Online Program Access & Support

  • Access: Access to the online program content is provided through our Kajabi platform. For breeder partnerships, access will be granted to puppy families when the puppies are 5 weeks of age.

  • Duration: Participants will have 12 weeks to access to the online course content from when the puppy goes home or at sign up. WhatsApp support is provided for 9 weeks from when the puppies go home (typically from Week 8).

  • WhatsApp Support: Support is provided via WhatsApp messaging for general questions and encouragement related to the program content. This is not a substitute for emergency veterinary care or intensive one-on-one behavioural consultations. Response times may vary but we aim to respond within 24-48 business hours.

  • Peer Group: Participation in any associated peer groups (e.g., Facebook, WhatsApp group) is subject to respectful conduct and adherence to group rules. We reserve the right to remove any participant who violates these rules.

6. Intellectual Property

All content on the Diona The Trainer website, including but not limited to text, graphics, logos, images, videos, audio, online course materials, guides (including the "Week-by-Week Puppy Development Guide"), and the "Good Puppy Blueprint" program content, is the property of Diona The Trainer and is protected by copyright and other intellectual property laws.

  • You may download and print materials for your personal, non-commercial use related to the services you have purchased.

  • You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any content on the website through which the service is provided, without express written permission from us.

  • Breeder partners are granted a limited, non-exclusive license to use the "Good Puppy Blueprint Approved" certification badge and provided marketing toolkit solely for promotional purposes related to their partnership with Diona The Trainer.

7. Disclaimers

  • No Guarantees of Results: While we strive to provide effective training and support, we cannot guarantee specific results or outcomes for any dog or owner. Dog training is influenced by many factors, including the dog's temperament, genetics, environment, owner consistency, and prior experiences.

  • Professional Advice: Our services and content provide general information and guidance. They are not a substitute for professional veterinary advice, diagnosis, or treatment for medical or severe behavioural conditions. Always seek the advice of a qualified veterinarian for any health concerns.

  • Safety: You are responsible for ensuring the safety of yourself, your dog, and others during any training exercises or interactions.

  • Website Accuracy: We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

8. Limitation of Liability

To the maximum extent permitted by law, Diona The Trainer shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

9. Indemnification

You agree to indemnify, defend and hold harmless Diona The Trainer and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

12. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
